Sizzle Media - Terms and Conditions

Miscellaneous Terms

In the course of the performance of any agreement, the parties may find it necessary to disclose certain confidential data or assets (information) to each other. In such an event, the following terms shall apply:

Each party that receives information (the receiving party) will treat the information received from the other (the disclosing party) as confidential, and use the same degree of care as the receiving party would employ in the protection of their own similar confidential information, provided the information is identified as confidential at the time of disclosure.

The receiving party will only use the information in connection with its performance of services under these terms and conditions, and shall disclose information only to employees who have a need to know, unless authorised in writing by the disclosing party.

Day to Day Contact

It is anticipated that, in the first instance any difficulties arising will be resolved between the respective Project Coordinators. In the unlikely even that this is not possible, you will have recourse to Sizzle Medias’ internal complaints procedure, which is founded upon the definition of a complaint as 'any expression of dissatisfaction requiring a response.'

This procedure will be adhered to throughout the life of the project. If a complaint cannot be resolved at this level, responsibility for dealing with complaints will rest with Sizzle Media’s Complaints Officer, who can be contacted at: support@sizzlemedia.co.uk subject titled 'Complaint'.

Payment Options

Any payment schedules that include a direct debit agreement, please note that Sizzle Media has appointed BACS approved Direct Debit bureau, Eazy Collect services (www.eazycollect.co.uk), to collect your payments and Eazy Collect will be shown on your bank statement.

Assumptions and Exclusions

The parties acknowledge and agree that the project fees, the delivery schedule and scope are expressly conditioned upon the following assumptions and exclusions:

  1. Except as otherwise expressly provided in the agreement or this Statement of Work, the client shall turnaround all requested information, materials and approvals within the timescales requested from SizzleMedia. Projects estimated as ‘days’ means ‘working days’ which excludes weekends.

  2. Sizzle Media’s services are provided on a project based fixed-fee basis. Circumstances encountered during a project may arise that are out of Sizzle Media or the clients control, and can affect the timeline and cost of the project, and thus the delivery date of the project.

  3. Any costs outside the scope of the original agreement, will be agreed between the parties prior to incurring those costs. Note that both the Eblaze Newsletter and Scorch SMS systems are ‘pay-as-u-go’ systems and priced to be the most competitive on the market. Your advisor will explain the current usage costs of these systems.

  4. Sizzle Media will not be held responsible for any delay or failure to comply with our obligations under these conditions, if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

  5. Sizzle Media does not allow illegal, abusive or offensive content on websites or anything contained in them which promotes or incites illegal activities in any jurisdiction. Sizzle Media reserves the right to refuse service based on content matching of these criteria, and will withdraw content at its own discretion without any prior notice.

  6. Sizzle Media will expect you to provide a copy of your logo, colour scheme and business fonts in a timely manner within 2 days of project initiation. The LAVA Platform is an integrated web based administration system that must be hosted with Sizzle Media, the use of which is included in the above pricing structure.

  7. In the case where the system is no longer required, all content, graphic elements and business data will be provided on disk for a fee of £199.
